It's apparently legitimate. I don't think Xploitedcinema would carry it if it wasn't on the level, and that's who sent it to me. There are some legal grey areas when it comes to releases from other countries (see any Red Sun release), but I've been made to understand that the Russain distributors have produced R0 NTSC releases of both Day and Night Watch.
edit= I just checked and both the R0 and R5 discs have been produced by the same company, which adds some proof to the legetimatcy claim.
